Terms and conditions of sale

1. Purpose and acceptance

These Terms and Conditions of Sale (hereinafter the "T&Cs") govern the sale of the services and products offered by TONIUTTI ASSOCIÉS (hereinafter the "Seller") via the www.adelinetoniutti.com website or by any other means of contact.

Any order implies the Client's full and complete acceptance of these T&Cs.

3. Services and products offered

TONIUTTI ASSOCIÉS offers in particular:

  • Artistic performances (concerts, recitals, appearances)
  • Individual vocal coaching and public speaking (in person and via video conference)
  • Corporate interventions, conferences, keynotes
  • Any books and educational content

Each service or product is the subject of a detailed description on the website or in a quotation provided to the Client.

4. Prices

Prices are indicated on the dedicated pages of the website or communicated by quotation prior to any order.

Prices are expressed in euros, all taxes included (TTC) for individual clients, and excluding taxes (HT) for professional clients. The applicable VAT rate is 20% (standard rate).

The Seller reserves the right to change its prices at any time; the prices applied are those in force at the time of the order.

5. Order and payment

Any order is confirmed after the Client's acceptance of these T&Cs and receipt of payment (in full or of a deposit depending on the service).

Accepted means of payment: bank transfer, bank card (via a secure provider) and any other means expressly accepted by the Seller. In the event of a transfer from abroad, exchange and commission fees are borne by the Client.

6. Right of withdrawal

In accordance with articles L.221-18 et suivants du Code de la consommation, the individual Client has a period of fourteen (14) calendar days from the conclusion of the contract to exercise their right of withdrawal, without justification.

This right is exercised by email to contact@adelinetoniutti.com.

After this period, no refund can be made. In the event of the Client's absence, lateness or early departure from a service, no refund is possible.

The right of withdrawal does not apply to services fully performed before the end of the period with the Client's express consent, nor to contracts concluded in a professional context (B2B).

7. Intellectual property

All content, texts, illustrations, teaching methods, recordings and performances of Adeline Toniutti are protected by copyright and remain her exclusive property (or that of TONIUTTI ASSOCIÉS).

Any reproduction, distribution, public communication or use for commercial purposes, in whole or in part, without prior written authorisation, is strictly prohibited and will engage the liability of its author under articles L.335-2 et suivants du Code de la propriété intellectuelle.

The audio or video recording of performances is subject to the prior express authorisation of Adeline Toniutti and may only be used in a strictly private setting.

8. Image rights

Any use of the image, name, voice or brand "Adeline Toniutti" for commercial or advertising purposes requires prior written authorisation.

9. Liability

The Seller implements all reasonable means to ensure the quality of its services. However, its liability cannot be engaged in the event of force majeure or of the Client's failure to fulfil their own obligations.

10. Personal data (GDPR)

The personal data collected is processed in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (loi Informatique et Libertés).

The Client has a right of access, rectification, objection, portability and erasure of their data, which may be exercised by email to contact@adelinetoniutti.com.

11. Complaints and mediation

Any complaint must be sent by email to contact@adelinetoniutti.com. A response is provided as soon as possible.

In accordance with article L.612-1 du Code de la consommation, the individual Client may, in the event of a dispute not resolved amicably, resort free of charge to the consumer mediator whose contact details are available on request.

12. Applicable law and jurisdiction

These T&Cs are governed by French law. In the event of a dispute not resolved through mediation:

  • for individuals: the competent French courts will be seized;
  • for professionals: exclusive jurisdiction of the Commercial Court of the Seller's registered office (Paris).

13. Amendment of the T&Cs

The Seller reserves the right to amend these T&Cs at any time. The applicable T&Cs are those in force on the date of the order.
